1. Privacy Policy

Effective Date: December 9, 2025

This Privacy Policy describes how Roommila and roommila.com ("we," "us") collect, use, disclose, and protect your digital personal data ("Personal Data") in compliance with the Digital Personal Data Protection Act, 2023 and the Information Technology Act, 2000.

1.1. Information We Collect

We collect information to provide and improve our Service. This includes:

  • Personal Data: Name, email, phone number, address, identity verification documents (KYC details), and profile pictures.
  • Usage Data: IP addresses, device information, and activity logs.
  • Content Data: Chat communications, notices, and uploaded lease agreements.

1.2. How We Use Your Information

We use your data for specified, lawful purposes, including:

  • Account management.
  • Facilitating communication between owners and tenants.
  • Identity verification.
  • Ensuring our no-brokerage service operates efficiently.

1.3. Sharing Your Information

We share your data:

  • With the other party: Relevant contact information is shared with your specific room owner or tenant to facilitate the rental agreement.
  • With Service Providers: Third parties who help us operate the service (e.g., hosting).
  • For Legal Reasons: If required by law or government requests.

1.4. Security of Your Data

We use technical and organizational measures (like encryption) to protect your data. While we strive for security, we cannot guarantee 100% security.

1.5. Your Rights as a Data Principal

Under the DPDP Act, 2023, you have rights including access to your data, correction, and erasure. You may contact our Grievance Officer to exercise these rights.

2. Data Retention and Deletion Policy

Our Commitment to Data Minimization and Storage Limitation

At Roommila, we adhere strictly to the principles of data minimization and storage limitation as mandated by the Digital Personal Data Protection (DPDP) Act, 2023. We retain your personal data only for as long as it is necessary to fulfill the specific purpose for which it was collected, or as required by Indian law. Once the purpose is served or your consent is withdrawn (unless legal retention is required), the data will be securely erased or anonymized.

Data Retention Periods

Different types of data are kept for different durations based on legal, regulatory, and business requirements:

Account Information

Data Type: Name, Email, Phone, KYC

Retention: Retained while your account is active to provide services like communication, agreement uploads, and member management. If an account is closed by the user, the personal data will be moved to an "expired" state and deleted within 90 days, unless a legal obligation requires longer retention (e.g., tax records for 6-8 years).

Lease Agreements & Legal Documents

Retention: Retained for the duration of the active tenancy and for a subsequent period as required by relevant Indian civil and tax laws to facilitate legal claims or regulatory audits.

Chat Logs & Notices

Retention: Stored securely while the account is active. Transaction-related logs and system access logs must be retained for a minimum of one year for audit and investigation purposes as per the DPDP Rules, even after account deletion.

Usage Data & Analytics

Retention: Retained for up to 26 months for internal analytics and troubleshooting, after which it is anonymized or deleted.

Your Right to Erasure (Right to be Forgotten)

As a Data Principal, you have the right to request the correction, completion, updating, or erasure of your personal data held by Roommila.

Data will be erased when:

  • The specified purpose for which the data was collected is no longer being served.
  • You successfully withdraw your consent for processing that data.
  • You formally request erasure, unless retention is necessary for compliance with another law currently in force in India.

How to Request Deletion:

You can exercise your right to erasure through your app settings or by contacting our Grievance Officer. We will verify your identity before processing the request to ensure security. We will respond to your request within the timeframe prescribed by the DPDP Act (typically within 90 days).

Notification

We will notify you at least 48 hours before any scheduled automated data erasure to give you an opportunity to continue using the service for the specified purpose (e.g., by logging in to keep your account active).

Secure Erasure

Data deletion involves the secure and irreversible removal of data from all relevant live storage locations.

Backups

Data may persist for a short period in encrypted backups, which are inaccessible during normal operations and are overwritten in subsequent cycles.

4. Terms and Conditions (T&C)

Effective Date: December 9, 2025

Please read these Terms and Conditions ("Terms", "T&C") carefully before using the Roommila mobile application (the "App") and the roommila.com website (the "Service") operated by [Your Company Legal Name, e.g., Roommila Solutions Private Limited].

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, owners, and tenants who access or use the Service.

4.1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service. You represent that you are at least 18 years of age and competent to enter into a binding contract as per the Indian Contract Act, 1872.

4.2. The Roommila Service and Role

Roommila is an online platform that acts solely as an intermediary to connect room/property owners ("Owners") with potential tenants ("Tenants"). We facilitate direct interaction and are not involved in negotiations or finalization of rental terms between the Owner and Tenant.

Important Disclaimer on Brokerage: Roommila operates strictly as a no-brokerage platform. We do not act as a real estate agent or broker.

4.3. User Accounts and Responsibilities

  • You must provide accurate, complete, and current information during registration.
  • You are responsible for maintaining the confidentiality of your account login details.
  • Users are solely responsible for verifying the identity, property details, and suitability of the counterparty met through the App before entering into any financial or legal commitment.

4.4. Digital Agreements and Documentation

  • The Service allows users to upload, view, and potentially e-sign lease agreements.
  • You are solely responsible for the content, validity, and legality of any document you upload or sign on the platform.
  • Roommila is merely a digital repository for these documents and does not verify their legal soundness.

4.5. Limitation of Liability

To the fullest extent permitted by law, in no event shall Roommila be liable for any indirect, incidental, special, consequential, or punitive damages arising from disputes between Owners and Tenants, or your use of the Service.

4.6. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of India. Any dispute shall be subject to the exclusive jurisdiction of the Courts located in [City where your company is registered, e.g., Bengaluru], India.
